Article 1: Presentation

These conditions of sale are concluded on the one hand by the company Mulebar Sasu whose head office is located at 14 rue Milton 75009 Paris, registered in the Paris trade and companies register under number 977 760 461 below called “Mulebar” and on the other hand, by any natural or legal person wishing to make a purchase via the website www.mulebar.com hereinafter referred to as “the buyer”.


Article 2: Purpose

These conditions of sale aim to define the contractual relations between Mulebar and the buyer and the conditions applicable to any purchase made through the merchant site www.mulebar.com, whether the buyer is a professional or a consumer.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by Mulebar.

Article 3: Characteristics of the goods offered

The products offered are those which appear in the catalog published on the site www.mulebar.com. These products are offered while stocks last.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the real product, particularly with regard to the colors.
In case a supplier modifies a product, the graphic representation thereof cannot engage the liability of the seller or even affect the validity of the sale.
The buyer must, if he does not have sufficient knowledge of the products, send to the seller so that he can validate the field of use or advise him in his purchasing process.


Article 4: Prices

The prices appearing in the catalog are inclusive of VAT in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
Mulebar reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The transport costs applied are only valid for Metropolitan France and Corsica (costs for the French Overseas Territories and other European countries communicated on quote). Free delivery is applied to shipments in Metropolitan France from 70 euros including VAT of purchases. For other destinations, the Chronopost international company rate is applied depending on the weight of the order and the country of destination.


Article 5: Order

The buyer who wishes to purchase a product must:
– Indicate their contact details defining the place of delivery
– Make payment under the conditions provided
– Confirm their order and payment
Confirmation of the order entails acceptance of these conditions of sale, recognition of having perfect knowledge of them and the waiver of taking advantage of one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.


Article 6: Withdrawal

Buyers, non-professional individuals, benefit from a legal withdrawal period of 14 days from delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of return fees. For any return of a product within the expected time frame, the buyer must, however, first send an email to contact@mulebar.com in order to obtain a return number (a number which he will write clearly on the outside of the package). This returns number guarantees the tracking of the product and its reimbursement. Under no circumstances can a package be returned without a return number.
The product must be returned in its original packaging and in its original condition. Any failure to comply with this obligation will result in non-reimbursement of the product(s) concerned.
Reimbursement of product(s) returned within the legal deadline will be made by bank transfer if payment was made by credit card or via Paypal if this service has been used, upon receipt of the returned products.


Article 7: Payment terms

The price is due when ordering.

Article 8: Deliveries

Deliveries are made to the address indicated in the order form which can only be in the geographical area agreed in article 4.
In the event of partial availability of the items ordered, Mulebar may separate the orders and thus ship the available items initially, the balance of the order then being sent upon receipt at Mulebar of the products ordered by the buyer.
The risks are the responsibility of the purchaser from the moment the products have left the premises of Mulebar or its logistician.
In the event of damage during transport, a justified protest must be made to the carrier within three days of delivery.
The delivery times delivery are given for information purposes only and non-compliance cannot under any circumstances give rise to order cancellation or any other claim; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed or Mulebar may offer to reship the goods to the buyer free of carriage.
Deliveries in France will be made via Colissimo or Chronopost, and indicative delivery times are on average 2 to 3 working days.


Article 9: Liability

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other involuntary problems.

Mulebar will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
Mulebar's computerized records will be considered by the parties as proof of the communications, orders, payments and transactions between the parties.


Article 14: Dispute resolution

These conditions of online sale are subject to French law.
In the event of a dispute, jurisdiction is assigned to the competent courts of Paris (75), notwithstanding the plurality of defendants or warranty claims.
